FOX 4’s “Keepin’ It Cool” 2010 Air Conditioner Contest

Who Can Enter

Entrants must be legal residents of Kansas or Missouri who own real property within a 50 mile radius of 3030 Summit, Kansas City, Missouri 64108 and who are 18 years of age or older and have lawful access to the Internet and a valid e-mail address at time of entry. Employees of WDAF TV/Local TV Holdings LLC, AB May, and Trane (collectively, “Sponsors”), their affiliated companies, advertising and promotion agencies, and the immediate family members of each such employee, are ineligible.

How to Enter

1. The contest begins when the online contest entry form is posted on www.fox4kc.com on July 1, 2010, and all entries must be received by 11:59 pm local Kansas City time on July 31, 2010 (the “Contest Period”). To enter, access the on-line contest entry form and follow all posted instructions. Entrants must guess the hottest day and temperature (in Fahrenheit degrees) during the month of August 2010. Entry constitutes an assignment to Sponsors of all of your intellectual property rights in the entry materials, if any. Except where prohibited by law, entry constitutes permission to use the winner’s name, hometown, likeness, and photograph for broadcast, online posting, or in any other media, and/or any advertising and publicity without additional compensation. Maximum one (1) entry permitted per e-mail address, per hour.

2. Sponsors are not responsible for any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction, or unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entries, communications with winner(s) or other contest information by Sponsors or entrants for any reason whatsoever. Sponsors are also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from downloading any materials in the contest or for entries that are late, misdirected or incomplete. All entries become the property of Sponsors and none will be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsors reserve the right to cancel the contest if it becomes technically corrupted.

3. From all valid entries received during the Contest Period, the entrant who selects the hottest day and temperature (in Fahrenheit degrees) during the month of August 2010 will be declared the winner. The determination of the hottest day and temperature during the month of August 2010 will be based on the official Kansas City International Airport temperature. Any disputes regarding the selection of the hottest day and temperature during the month of August 2010 will be determined in Sponsors’ sole discretion. If more than one entrant selects the same correct day and temperature, winner will be selected by random drawing from among all correct entries received. The winner will be selected on or about September 3rd, 2010.

The Prize

4. The winner will receive one (1) XB13 Trane air conditioner (model to be determined by the square footage of the dwelling. Winner will also receive tear-out and disposal of their current air conditioner unit (if applicable) and installation of the Trane air conditioner. The approximate retail value of the prize is $2,500.00 (depending on the square footage of the dwelling). The Trane air conditioner must be installed by December 31st, 2010 or the winner will forfeit the prize. The winner must have the Trane air conditioner installed at the real property they own within the 50 mile radius of 3030 Summit, Kansas City, MO 64108. The Trane air conditioner is intended for installation in a residential or small office environment.

5. The winner will be notified by e-mail and/or phone on September 3rd, 2010. The winner must provide his or her name, address, telephone number and birthdate to Sponsors at the time of notification. The winner will be required to complete, sign and return a Certification of Eligibility and Liability/Publicity Release within 48 hours of the date of notification or he or she will be disqualified. If a winner cannot be reached, or if a winner does not return the Certification of Eligibility and Liability/Publicity Release within the designated time period, the winner will be disqualified and the prize will be awarded to a substitute winner selected at random from among all remaining eligible entries. AB May will handle fulfillment of the prize and the issuing of the 1099 form.

6. The prize cannot be redeemed for cash or substituted for any other items by the winner. The winner cannot assign or transfer the prize. Sponsors reserve the right to substitute any prize or component of any prize package with a prize or component of like or greater value, including cash, for any reason.

7. The winner is responsible for all local, county, state, and federal taxes on prize based on the value of the prize set forth in these rules.

8. Individuals are eligible to win only one (1) prize offered by WDAF TV within any 30-day period, regardless of the number of contests entered.

Odds of Winning/Miscellaneous

9. The odds of winning depend on the number of eligible entries received.

10. Copies of these contest rules are available at fox4kc.com and Monday through Friday during normal business hours at WDAF TV 30303 Summit, Kansas City, MO 64108 through July 31, 2010.

11. For the name of the prize winner, send a separate, self-addressed, stamped envelope after August 30, 2010 to: “Keepin’ It Cool” Contest / WDAF TV 3030 Summit, Kansas City, MO 64108.

12. This contest is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, the establishment of a trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsors are not responsible for typographical or other errors in the printing, offering, or administration of the contest, or in any announcement relating to the contest.

13. By entering, entrants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, which shall be final in all respects, (b) to release Sponsors, their corporate parents, subsidiaries, affiliates, and promotion agencies and the directors, officers, employees, and agents of each of these entities from any and all liability and claims for any injuries, losses, or damages of any kind caused by any prize or resulting from the acceptance, possession, use, or misuse of any prize, and (c) to the use of an entrant’s personal information as described in WDAF TV’s Privacy Policy located at fox4kc.com.
